Terms and rules for using our services
§ 1General information
These Terms of Service set out the rules for using the Murder Mystery Files website (the "Service") and the terms for providing electronic services by Passionnet Sp. z o.o., with its registered office in Warsaw (00-363), ul. Nowy Swiat 54/56, entered in the register of entrepreneurs of the National Court Register under number 0000897484, NIP 5252861218 (the "Company").
Use of the Service is voluntary and available to any User who meets the Terms. By creating an account, accessing the Service, or using the services offered through it, the User confirms that they have read and agree to these Terms. If the User does not accept any provision, they should immediately stop using the Service.
§ 2Description of services
Murder Mystery Files is an immersive detective game that combines physical elements with digital ones. The Service enables Users to:
- browse publicly available content such as the blog with themed articles;
- register an account and access exclusive materials available only to registered players;
- after purchasing the physical game, enter a unique code in the Service to unlock the interactive map panel and related digital content (such as puzzles, clues, and personalized PDF documents that are part of the story).
The detective gameplay uses both the physical materials delivered with the purchased game (for example, evidence envelopes) and the interactive online platform available through the Service. These parts complement each other and create a cohesive experience.
§ 3Age and eligibility
The Service is available to individuals who are at least 16 years old. Minors (under 18) may create an account and use the game only with the consent of a parent or legal guardian. By creating an account, the User declares they meet this requirement and, if aged 16 to 18, have obtained the required consent.
§ 4Account registration
To access certain features of the Service, the User must register an account. During registration, the User is required to:
- provide true, current, and complete data required by the registration form (including email address and chosen username);
- update the data if it changes while using the Service.
Each person may have only one account in the Service. Creating multiple accounts by the same User is prohibited. If access to the account is lost (for example, forgotten password), the Company may request additional identity verification to restore access.
§ 5Access to restricted sections (access code)
Certain sections of the Service - in particular the map panel, which is a key element of the game - are available only to Users who purchased the physical version of Murder Mystery Files. Access is granted by entering a unique access code provided with the purchased game.
Each access code may be assigned to a maximum of four User accounts (email addresses). This means the buyer can share the code with up to four people (including themselves) to use the map panel and take part in the game. The code is for authorized persons only and may not be publicly shared or resold. Violation of these rules may result in blocking the code or accounts associated with its unauthorized use.
§ 6User responsibilities and conduct
A User using the Service agrees to follow these rules:
- Account security: Keep login credentials confidential and do not share them with third parties. The User is responsible for all actions taken using their account.
- Permitted use: Use the Service and all content provided only for personal, non-commercial purposes. Using the Service beyond personal use, including commercial use of game elements without the Company's consent, is prohibited.
- Respect for exclusive content: Do not share, copy, or distribute materials and content available only to registered Users (such as puzzles, descriptions, story documents, or multimedia materials). This includes publishing such content on other websites or platforms.
- Lawful conduct: Follow all applicable laws while using the Service and services. In particular, the User must not provide unlawful, offensive, rights-infringing, or otherwise improper content.
- Prohibition of abuse: Do not use the Service in a way that could disrupt its operation or harm other Users (for example, hacking attempts, introducing malware, bypassing security measures, or excessive load on the Service infrastructure).
If the User violates these obligations, the Company may take appropriate actions, including restricting access to certain features, temporarily suspending or deleting the account, and, in serious cases, taking legal steps.
§ 7Intellectual property rights
All content provided in the Service, including text, graphics, photos, videos, interface elements, audio works, trademarks, logos, and other legally protected elements, belongs to Passionnet Sp. z o.o. or is used by the Company under appropriate licenses or permissions. These materials are protected by law, in particular copyright and related rights and industrial property law.
Without the prior written consent of the Company, it is prohibited to copy, distribute, modify, publicly display, or otherwise use content from the Service, except for permitted use under applicable law. Any attempts to infringe intellectual property rights may result in civil or criminal liability and actions described in section 6 (including suspension or deletion of the User account).
§ 8Privacy protection
Protecting Users' personal data and privacy is very important to us. By using the Service, the User accepts the rules for processing personal data described in our Privacy Policy. That document explains what data we collect during registration and use of the services (for example, email address, username, gameplay history), how we use and store it, and what rights the User has (including access, rectification, or deletion).
We encourage you to read the Privacy Policy carefully. If you have any questions about data processing, please contact us as described in the Privacy Policy.
§ 9Payments and purchases
The Service may allow the purchase of the physical Murder Mystery Files game directly from the Company or via external platforms (details of external platform sales are described in section 15). Below are the general payment and purchase terms:
Payment processing
Payments for products offered by the Company are made in advance using available electronic payment methods (for example, online transfer, payment card, or other systems). All prices listed in the Service are gross prices (including taxes) and are stated in Polish zloty (PLN), unless explicitly stated otherwise.
Delivery of products
The purchased physical game will be delivered to the address provided by the User when placing the order, according to the delivery times listed on the website. The Company makes every effort to deliver within the specified time but is not responsible for delays caused by courier companies or other circumstances beyond its control.
No right of withdrawal - legal exceptions
As a rule, due to the nature of the game (puzzles and materials whose value cannot be "reversed" once revealed), purchased products are not subject to return or exchange. This does not limit statutory consumer rights. If the User is a consumer under applicable law, they have the right to withdraw from a distance contract within 14 days of receiving the product, unless statutory exceptions apply. To exercise the right of withdrawal, the consumer should submit a relevant statement (for example, in writing or by email). In the event of effective withdrawal, the contract is deemed not concluded and the Company will refund all payments received for the product in accordance with the law (no later than 14 days from receipt of the withdrawal statement).
Complaints about physical products
The Company is obliged to deliver products free from defects. If a delivered product is defective or non-conforming, the User (as a consumer) may submit a complaint based on warranty regulations within 2 years of delivery. Complaints can be submitted in writing to the Company's registered office or electronically. The complaint should describe the defect and the requested remedy (for example, replacement, price reduction, or withdrawal with refund). The Company will respond within 14 calendar days of receipt.
Access codes and limitations
After purchase, the User receives a single-use access code for the digital part of the game (the map panel). This code can be used only once to activate access. If the code is lost, the Company does not guarantee a replacement. The User should secure the code against unauthorized use.
§ 10Disclaimer of warranties
The Company makes efforts to ensure that the Service and its services operate continuously and without errors, but they are provided "as is." The Company makes no warranties or representations, express or implied, that the Service or services will meet the User's expectations, operate without interruptions or errors, or that errors will be corrected within a specific time.
The Company reserves the right to limit or suspend access to the Service periodically, in particular for technical reasons, system maintenance, or events beyond the Company's control. The Company is not responsible for temporary interruptions or difficulties caused by these circumstances.
§ 11Limitation of liability
To the fullest extent permitted by law, the Company is not liable for damages resulting from the User's use or inability to use the Service or the services offered by the Company. This includes, in particular, damages such as data loss, downtime, lost profits, or other material or non-material damages, whether direct, indirect, incidental, or consequential.
The Company is also not responsible for actions or omissions of third parties whose services it uses to operate the Service or process payments (for example, payment operators, hosting providers, courier companies), where such entities bear responsibility to the User under separate regulations or agreements.
Nothing in these Terms limits consumer rights granted under mandatory law. In particular, the above limitations are not intended to infringe consumer rights.
§ 12Changes to the Terms
The Company reserves the right to amend these Terms at any time. When changes are made, the updated Terms will be published in the Service along with the effective date of the new version. If changes are significant, the Company may inform Users in advance, for example by email to the account address.
The User is required to review the current Terms when logging in or using the Service. Continued use after the changes take effect constitutes acceptance. If the User does not accept changes, they should stop using the Service and may delete their account.
§ 13Governing law and jurisdiction
Polish law applies to all legal relations arising from these Terms or the provision of electronic services by the Company. Matters not covered by these Terms are governed in particular by the Act of 18 July 2002 on the provision of electronic services, the Act of 30 May 2014 on consumer rights, and the Civil Code.
Any disputes between the Company and a User who is a consumer will first be resolved amicably. If an amicable resolution is not possible, the competent court will be determined according to applicable law (for consumers, the court of general jurisdiction or the consumer's place of residence). For Users who are not consumers, the competent court is the court with jurisdiction over the Company's registered office.
§ 14Complaint procedure and out-of-court dispute resolution
The User may submit complaints related to the operation of the Service or the quality of services. Complaints can be submitted electronically to info@murdermysteryfiles.com or in writing to the Company's registered office (listed in section 16 below).
A complaint should include the name (or username) of the complainant, a description of the issue, and the requested remedy (for example, restoring account access, removing errors, replacing a product). The Company will handle complaints within 14 days of receipt. A response will be provided by the same channel as the complaint unless the User requests a different form.
If the User is a consumer and is not satisfied with the complaint handling, they may use out-of-court methods to resolve disputes. A consumer may, among other things:
- submit a request to a permanent consumer arbitration court (operating at the Trade Inspection) to resolve a dispute arising from a contract;
- seek assistance from a municipal or county consumer advocate;
- file a complaint via the EU online dispute resolution platform (ODR), available at ec.europa.eu/consumers/odr.
Detailed information on out-of-court complaint and dispute resolution is available on the website of the Office of Competition and Consumer Protection (UOKiK) and in the Consumer Rights Act.
§ 15Sales through external platforms
The Company may offer products through external sales platforms such as Amazon or Allegro (or other services listed on murdermysteryfiles.com). If a purchase is made through such a platform, the terms of sale (including payment, delivery, withdrawal, and complaints) are governed by the platform's terms and policies.
The Company is not responsible for the course of transactions or any issues related to orders, payment, delivery, or returns of products purchased via external platforms. For questions or issues regarding orders placed on platforms like Amazon or Allegro, the User should contact the customer service of the relevant platform directly.
